Terms and Conditions

These Terms of Service (the “Terms”) constitute a legal agreement between you (the “User” or “Customer”) and Elefant Inc. (the “Company,” “we,” “us,” or “our”) governing your use of the malware, virus, and backdoor removal and recovery services (the “Services”) provided through Quick Rescue (the “Site”) and Quick Rescue 365. By using, applying for, purchasing, or otherwise accessing the Services through this Site, you are deemed to have agreed to these Terms and our Privacy Policy (which is incorporated herein by reference). If you do not agree to these Terms, you may not use the Services.

 Personal Information Protection and Privacy Policy

Our Privacy Policy forms an integral part of these Terms.
Please review it to understand how we collect and use your personal information and data in connection with the Services.

We comply with the Act on the Protection of Personal Information and all other applicable laws and regulations, and we manage and protect your personal information appropriately.
By using the Services or accessing the Site, you are deemed to have consented to the collection, use, storage, processing, and disclosure of your personal information in accordance with our Privacy Policy.

Conditions of Use

  • Changes to the Services and Pricing
    We reserve the right to change the content and pricing of the Services at any time.
  • Additional Fees for Repair Work
    When you engage us for WordPress or website error-repair work, additional fees may apply for any information not disclosed prior to your application or for any individual errors outside the scope of the original consultation.
  • Account Responsibility
    You are responsible for managing your own site and account credentials (username and password)
    and for keeping them secure at all times.
    If unauthorized use or a security breach is suspected, you must change your credentials immediately.
  • Responsibility for Your Operating Environment
    You are solely responsible for providing the software, hardware, internet connection, and other resources required to use the Services. Mobile data charges incurred when using the Services on a mobile device are also your responsibility.
  • Service Availability
    We do not guarantee the availability of the Services. The Services may be temporarily unavailable due to maintenance, upgrades, or other reasons.
    We may also modify, remove, or suspend the Services without prior notice.
  • Eligibility
    To use the Services, you must be at least 20 years of age or have reached the age of majority in your jurisdiction of residence.
    If you do not meet this eligibility requirement, you may not use the Services.

Service Results, Timeframes, and Customer Reviews

  • No Guaranteed Timeframe Unless Expressly Agreed
    Statements on the Site, landing pages, advertisements, emails, or other materials such as “as little as 30 minutes,” “same-day recovery,” “urgent response,” or similar wording describe examples, estimates, or past cases. They do not constitute a guaranteed response time, completion time, service-level agreement, or promise that your site will be fixed by a specific time unless we expressly agree to that in writing for your individual case. Actual response and recovery time depend on factors including the symptoms, infection scope, hosting environment, third-party systems, the accuracy of information you provide, the availability of required credentials, and your response time.
  • Individual Results May Vary
    Examples of past recoveries, customer experiences, or service results are provided for general informational purposes only. They do not guarantee that the same or similar result will be achieved in your case. The Services depend on the condition of your site, server, database, backups, third-party services, and other circumstances outside our control.
  • Customer Reviews and Translations
    Customer reviews, testimonials, and review-count references displayed on the Site or in our materials may include reviews originally posted in Japanese on third-party platforms such as Coconala, Udemy, Street Academy, and similar services, and may be translated into English. Translated wording may be lightly edited for clarity, readability, formatting, or length without changing the substance of the review. Unless expressly stated otherwise, total review counts may include reviews of our courses, consultations, website-related services, and recovery-related services, and do not represent the number of completed recovery orders. Reviews reflect individual experiences and are not a guarantee of future results.
  • Advertising References Are Subject to These Terms
    Any references to “free diagnosis,” “Money-Back Guarantee,” “full refund,” “re-recovery guarantee,” “risk-free,” or similar wording are subject to the agreed scope of work, these Terms, and any additional written terms presented at the time of purchase or engagement.

Refund and Cancellation Policy

Our goal is to deliver the highest-quality Services to our customers. We value long-term relationships with our customers and place the highest priority on your satisfaction with our Services. We also recognize, however, that in certain cases a refund may be necessary.

  • Fees
    The use of paid Services requires payment by credit card, PayPal, or similar method.
    QuickRescue is priced per site (one purchase is required per site).
  • Immediate Billing and Result-Backed Guarantee
    The Services are billed immediately at the time of purchase. Payment is required in advance.
    However, one-time recovery Services are backed by the refund guarantee below if we cannot complete the agreed recovery, malware removal, virus removal, or backdoor removal after you provide the required access credentials.
  • Full Refund Guarantee for Unsuccessful Recovery
    You may apply for a refund under the conditions specified below. Refunds are issued only for the applicable paid Service and site covered by the approved refund request.
    • References on the Site, landing pages, advertisements, emails, or sales materials to a “Money-Back Guarantee,” “Full Refund Guarantee,” “full refund,” or similar wording mean only the refund guarantee described in this section.
      They do not create an unconditional right to a refund for Customer-caused issues, deleted data, unrelated new problems, out-of-scope repairs, non-cooperation, incorrect credentials, third-party service issues, completed work, or any other excluded case described in these Terms.
    • If, after you have provided us with the required server credentials and we have performed work on your server,
      we are unable to recover your site or unable to remove the malware, viruses, or backdoors within the agreed scope of work, we will issue a full refund of the amount you paid for the applicable one-time recovery Service for that site.
      No credit-card processing fees, PayPal fees, or transaction handling fees will be deducted from this refund.
    • The refund guarantee applies only to the agreed recovery, malware removal, virus removal, or backdoor removal scope for the site purchased. Any additional repairs or additional errors discovered after the fact, and any cases where some or all of the server data — including backups — has been deleted based on information provided by you, are not eligible for the refund guarantee. Deleted data or images that are not present in any backup are not covered by the recovery guarantee or the refund guarantee.
    • Re-Recovery Guarantee Period
      Infected sites remain at risk of re-infection even after cleaning. Under the one-time recovery Services, we will re-clean or re-recover the site at no additional charge if the same symptom, malware infection, virus infection, or backdoor issue returns within the applicable guarantee period after completion of our work.
      Errors or issues arising from your own actions, new unrelated issues, hosting-fee problems, expired domains, third-party changes, new sites or installations not included in the original order, and work outside the agreed scope are not covered by the recovery guarantee.
      If malware-, virus-, or backdoor-infected files remain elsewhere on the same server, no recovery guarantee will apply until all such files have been removed. The guarantee applies only after all such files have been removed.
      • Recovery Plan: 90 days after completion
      • Secure Plan: 6 months after completion
      • Incident Response Plan: 6 months after completion
      • QuickRescue 365 Plan: re-recovery from recurrence, infection, or lockout is included while the subscription remains active, subject to the subscription scope and these Terms.
  • Refund Conditions
    1. Cancellations made before work begins (before payment) are free of charge.
    2. If, after you have provided us with the required server credentials and we have performed work on your server, we are unable to remove the malware, virus, or backdoor, or unable to recover your site within the agreed scope of work, we will issue a full refund.
    3. Refunds issued under item 2 above will be for the full amount paid for the applicable one-time recovery Service for the relevant site. We will not deduct credit-card processing fees, PayPal fees, or transaction handling fees from this refund.
    4. No refund will be issued if the agreed recovery, malware removal, virus removal, backdoor removal, or repair work has been completed successfully.
    5. You agree to give us a reasonable opportunity to resolve any issue before requesting a refund.
    6. Purchases made via special email offers, as well as recurring subscription plans (monthly or annual), are not eligible for cancellation refunds or change-of-mind refunds. However, this does not limit the full refund guarantee if we cannot complete an agreed one-time recovery, malware removal, virus removal, or backdoor removal Service.
    7. Any additional repair items or undisclosed errors discovered after the work has been performed (after payment) will be subject to separate fees, and such additional items or individual errors are not covered by the repair guarantee, recovery guarantee, or refund guarantee.
    8. The following cases, occurring after the work has been performed (after payment), constitute cancellations for reasons attributable to the Customer and are not refundable: failure to disclose server login credentials (ID and password); inability to log in using the credentials provided; inability to perform work using the disclosed credentials; the server no longer existing; errors caused by unpaid hosting fees or expired domains; discrepancies between your declared information and the actual situation; or discovery, after work has commenced, that all data — including the database — has been deleted from the server. We perform same-day work, work preparation, communication, response monitoring, project management, late-night work, and early-morning response in order to address customer issues as quickly as possible and provide peace of mind. For these reasons, refunds will not be issued in such cases.
    9. If you provide us with incorrect server credentials (whether intentionally or through negligence) and we perform work on the basis of those credentials, no refund will be issued even if you subsequently correct the information. This is because we have already performed work on the server you disclosed to us. In such cases, please submit a new, separate application.
    10. If, after the work has been performed (after payment), you fail to provide the server credentials required to complete the work for more than three days, this will be treated as a cancellation for reasons attributable to the Customer. Because we will have already carried out work preparation and ancillary tasks, no refund will be issued.
  • Refund Processing Period
    Refund processing requires a minimum of 7 days from the date of application.
    The period may be extended depending on circumstances at the payment service provider or similar parties.

We further reserve the right to cancel or terminate the Services at any time and for any reason.
In such cases, except where cancellation or termination is due to Customer breach, prohibited conduct, abuse, non-cooperation, or another reason attributable to the Customer, we will issue a refund for any portion of the Services that has not yet been completed.

Malware, Virus & Backdoor Removal Services

  • File Modification and Deletion
    As a result of the malware removal Services, some or all of the files on your site may be modified, deleted, added, or updated.
  • Data Loss
    If files have been deleted due to malware, viruses, backdoors, or similar causes, complete recovery cannot be guaranteed unless you maintain your own backup.
    Some images or data may be missing. We assume no liability if your site is damaged.
    You must take your own backup before using the Services.
  • Minimizing Site Downtime
    We will use commercially reasonable efforts to minimize downtime.
  • Pre-Submission Site Review
    Before submitting your site information, please review the contents of your site yourself.
    Some files, images, or data may be deleted or altered as a result of malware, virus, or backdoor activity, or as a result of removal work.
    You must take a fresh backup yourself before work begins. We accept no liability whatsoever for data loss, site damage, or similar consequences arising after work has been performed.

Scope of Liability for Third-Party Products and Services

Issues arising from third-party themes or plugins, third-party servers, or custom development are outside the scope of our support.
Configuration and similar items not directly related to the Services are likewise outside the scope of our support.

Payment Methods and Purchases

  • Payment Methods
    Payment may be made by credit card or PayPal. Credit card information is not stored by us; it is transmitted directly to PayPal or other payment service providers.
    We do not retain credit card information under any circumstances.
  • Information Required at Time of Purchase
    At the time of purchase, you will be required to provide your name, site information, site login credentials, server credentials, and similar information.

Subscriptions

Certain Services are offered on a subscription basis (recurring billing). Payment is charged in advance.
No pro-rated billing is provided.

Subscriptions are billed on a recurring monthly basis until cancelled.
When a subscription is terminated or cancelled, the Services end immediately at that point, and no pro-rated refund will be issued for any unused portion of the billing period.

Upon subscription cancellation, the malware countermeasures, virus countermeasures, security configurations, and security codes implemented under the subscription will be removed, either automatically or manually. You will need to reconfigure these settings yourself.

You may request cancellation of a subscription through our contact form or the support channel used for the Service. Unless otherwise agreed in writing, cancellation takes effect when processed and confirmed by us, the subscription Services end immediately at that point, and no pro-rated refund will be issued for any unused portion of the billing period.

Content

You are solely responsible for any information, text, images, videos, or similar materials (the “Content”) that you post, link to, share, or otherwise transmit when using the Services.
We assume no liability whatsoever for any issues arising from such Content.

Priority Support

Active Service customers receive priority support by email and chat. We do not guarantee any specific response time or service-level agreement (SLA).
While we generally strive to respond promptly during recovery work, we make no guarantees regarding response times or resolution times. We aim to reply to emails within 12 hours.
If our support team is subjected to insults, threats, abusive language, or similar conduct, we will terminate the Services immediately and no refund will be issued. Configuration and similar items not directly related to the Services are not covered by support.

Prohibited Conduct

You shall not engage in any of the following conduct:

  • Impersonating another person or providing false information
  • Placing excessive load on our Services or networks
  • Violating any law or public order and morals
  • Abusive language, defamation, or intimidating conduct directed at our staff
  • Reselling or repurposing the Services to third parties without authorization
  • Any other conduct that we deem inappropriate

If any such conduct is confirmed, we may suspend the Services, terminate the contract, declare amounts non-refundable, or take other appropriate action.

Disclaimer of Warranties and Indemnification

  • Recovery Services
    Recovery under this Service is provided on an “as-is” basis.
    We make no warranties, express or implied, of any kind, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement of third-party rights, accuracy, completeness, security, reliability, or availability.
  • Liability for Site Damage
    Files, images, data, and other materials may be deleted or altered as a result of malware, virus, or backdoor activity, or as a result of removal work. You must take a fresh backup yourself before work begins. We accept no liability whatsoever for data loss, display issues, site damage, or similar consequences arising after work has been performed.
  • Indemnification and Limitation of Liability
    You shall indemnify, defend, and hold harmless the Company and its officers, employees, and agents from and against any and all damages, obligations, losses, and expenses (including reasonable attorneys’ fees) arising in connection with the following:
    • Your use of or access to the Services
    • Your breach of these Terms
    • Your infringement of any third-party right (including rights of privacy and intellectual property)
  • Limitation of the Company’s Liability
    To the extent you are entitled to claim damages against us in connection with your use of the Services, our liability shall be limited to the amount actually paid by you for the Service in question.
    The foregoing limitation does not apply in cases of willful misconduct or gross negligence on our part.

Modification of These Terms

We reserve the right to modify these Terms at any time.
When the Terms are modified, posting of the revised Terms on this Site shall constitute notice, and the revised Terms shall take effect from the time of posting.

Governing Law and Jurisdiction

To the maximum extent permitted by applicable law, these Terms shall be governed by and construed in accordance with the laws of Japan, without regard to conflict-of-law rules. You and the Company agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or the Services shall be subject to the exclusive jurisdiction of the Tokyo District Court in Japan as the court of first instance. This clause does not limit any non-waivable consumer protection rights that cannot be waived by law, and it does not restrict the authority of governmental or regulatory bodies where applicable.
